GENERAL TERMS AND CONDITIONS
VALID FOR DELIVERIES INSIDE OF GERMANY AND DELIEVERIES INTO
EU-COUNTRIES OR NON-EU-COUNTRIES

Applicability:

For all business relations between UW-Diveware and the customer, only our General
Terms and Conditions will be binding in their version valid on the date of order.
Any variations of the customer to this agreement must be confirmed by us in writing.

The following terms and conditions (as at January 2008) are part of the contract of sale
between UW-Diveware and the customer.

1. Conclusion of the contract
The prices for the final costumer are in Euros and include the VAT of 19%,
Handling and Shipping are not included (see 6). This offer is subject to change.
We are not responsible for printing or typographical errors.
All transactions are subject to our general terms and conditions.
The sales contract between UW-Diveware and the ordering party shall become
effective when such order is approved by us per e-mail. This approval will contain once
more the designation of the ordered items and the price.

2. Order
(1) Online shop
You can order our products 24 hour s a day. After you have ordered you will receive an
e-mail confirmation.

(2) Written order
Alternative you have the choice to order all products per mail, fax or e-mail.
Please indicate the quantity, order numbers, aricles and your complete address.

We only accept bank transfer as payment method (cash before delivery), that means
we send the parcel when cashed. All currencies exchanges costs and additional bank
charges have to be paid by the buyer. Please, include this costs in the amount.
The products will be despatched immediately after receipt of the payment.

3. Right to cancel the order or to return goods of the ordering party
(1)The customer who orders something will not be bound to his declaration of agreement
to the sales contract if he cancels the order within 2 weeks upon receipt of the first delivery.
It is not necessary to give reasons for the cancellation, but it has to be done in writing,
with mail, fax or e-mail. To meet the deadline, it will be sufficient to send the cancellation
of the order in time to: UW-Diveware, Alexandra Magnussen, Saleggstr. 13, 81547 Munich, Germany.
Not-prepaid packages returned without a valid RA will be refused and sent back to the sender
(2) The right of the ordering party to cancel the order does not apply to following goods:
- articels that have been made to customers specification, or where it is obvious that
the goods have been specially tailored to his personal needs
- goods that are not suitable to be sent back due to its nature
- underwear and bathing clothes
- items at reduced prices.

4. Warranty
In general, the statutory warranty period of 2 years shall apply. Warranty claims may
only be made by the direct buyer. The guarantee is always limited to the respective item,
and is effected by repair or exchange, at our choice. We do not take responsibility for
any damage due to improper handling or usage, as well as defects due to normal wear
and tear. Furthermore, we reject to take any responsibility for indirect losses. We shall
not be liable for the accuracy of any technical data or any other information not
particularly referred to by us.

5. Delivery damages
All deliveries will be insured. The insurance fee is part of the shipping costs. The amount
insured is fixed from our transport enterprises Deutsche Post/ DPD. The goods have
to be checked for completeness and any defects immediately on delivery. Any transport
damage has to be reported within 24 hours to the respective "local" shipping company.
t is non-permissible to set off any payments against the claims due to damages upon delivery.


6. Shipping and handling

(1) Delivery times:

Normally storage goods will be shipped within 3-5 working days. Goods that have to be
ordered will be shipped within 7-14 days, depending of the kind of product. We guarantee
a delivery time of not more than 30 days for all articles, except for those made to customers
specification. In such case the buyer will be informed by us. Any other agreements as to
the delivery shall be stipulated in writing. Any unforeseeable impediment to performance,
such as cases of force majeure, interruption of operations etc. shall give us the right to
withdraw, in whole or in part, from the supply commitment. Any claims for damages because
of delayed supply shall be excluded. Partial deliveries are admissible.
(2) Shipping and handling (national)
The forwarding charges depend of weight and quantity. For partial deliveries shipping
is charged only once. National shipping is over an amount of EUR 300.00 free. Cash on
delivery charge is EUR 4.00 plus EUR 2.00 wire transfer fee. The prices for delivery
are automatically generated. No responsibility is taken for the correctness of this information.
(3) Shipping and handling (international)
The delivery charge depends of weight, quantity, and destination. The price for delivery
in each country will be automatically generated in the checkout process by weight.
We reserve the right to choose the most favourable way of delivery. As the prices are
automatically generated, no responsibility is taken for the correctness of this information.

7. Payment
The goods shall remain our unmarketable property until full payment of the price is made.
The right of property also includes any interest or ancillary costs accruing from the
obligation to pay the goods. Any right to retain or to set off the payment shall be excluded.

(1) Payment (national)
The prices at the time of order are valid. All prices are including 16% german VAT.

a) Prepayment
After your order an invoice is automatically generated and sent to you by e-mail.

PayPal
After your order a link to PayPal is sent to you by e-mail. There you are guided through the payment process.
The charges for this payment method are 4,5% (free of charge within Germany).
(2) Payment (international)
b) Prepayment EU Member States
We only accept bank transfer as payment method (cash before delivery), that means
we send the parcel when cashed. After your order an invoice is automatically generated
and sent to you by e-mail. Please remit the invoice value to the following account:
c) Prepayment Non-EU Member States (like Switzerland)
All currencies exchanges costs and additional bank charges have to be paid
by the buyer. Please, include this costs in the amount (e.g. Switzerland 5.00 EUR).

8. Copyright
We hold the copyright to all delivered samples, articels, images, artefacts, and all other
items. Unauthorized imitation, reproduction, or copy is forbitten. Unless otherwise noted,
we hold the copyright on all of the content on all of our pages.

9. Privacy notice
We will not give or sell confidential or Personal Information about our customer to any
third party. We use 128bit-SSL (Secure Socket Layers) to encrypt your bank information
and personal data while they are in transit through the internet.

10. Final provision
In case any of the above provisions become void, for whatever reason, the validity of
the other provisions shall remain unaffected. Wherever applicable (e.g. among merchants),
Munich shall be the place of juristiction for any disputes araising from this contact between
the customer and UW-Diveware.
